Eby Jobsite Safety Performance Highlights:

• In October 2005, the Special Projects group completed ELEVEN YEARS OF PERFORMING WORK WITHOUT A LOST-TIME ACCIDENT.

• As of September 2006, the Boeing Wichita Projects Team surpassed TWO YEARS OF PERFORMING WORK WITHOUT A LOST-TIME ACCIDENT.

• As of June 23, 2006, the Company completed one year without a lost-time accident.

The Company's exceptional safety performance is a direct and continuous result of effective planning for safety at the project level, conscientious leadership and a moral commitment of the company to provide a safe working environment.

COMPANY SAFETY AND HEALTH POLICY STATEMENT

The objective of the Martin K. Eby Construction Co., Inc. Safety and Health Policy is to protect the lives and safety of our employees, subcontractor employees, customers and the public in all our operations.

Safety will be considered in planning and executing all company activities.

All employees will consider the safety and health of employees, customers and the public in every job they do.

To carry out this Safety and Health Policy, the Company will:

1. Maintain safe and healthful working conditions.
2. Furnish adequate mechanical safeguards and personal protective equipment wherever needed.
3. Maintain active and aggressive safety and health programs that all employees will support to promote safety and health awareness among employees.
4. Provide medical and first aid facilities for work-related injuries and illnesses.
5. Maintain a continuous educational program in safe operating procedures.
6. Insist that all employees follow established safety rules and use the safety equipment provided.
7. Promote safety with all subcontractors and their employees.
